Court of Appeal rules on wrong verdict case

The case in which jurors had complained in March that the foreman handed down the wrong verdict in a carnal abuse case, has been settled by the Court of Appeal.

Last week the Court of Appeal sent back the case to the Home Circuit Court for Kevin Bryan, 36, security guard and football coach to be sentenced.

Bryan was charged with rape committed on a 13-year-old girl. The jury found him not guilty of rape, but when asked what was their verdict in relation to carnal abuse, the foreman said guilty.

After the seven-member jury left the courtroom, six of them returned sometime after and told court officials that the foreman had given the wrong verdict.

Mrs. Justice Almarie Sinclair Haynes who presided at the trial in the Home Circuit Court sent the matter to the Court of Appeal for its direction.

The Court of Appeal ordered that Bryan should be sentenced.

Bryan was sentenced on Thursday to three years imprisonment.

The Court of Appeal will hand down its written reasons at a later date.
